U.S. Files USERRA Class Action Against American Airlines

The U.S. Justice Department has filed the first class action lawsuit under the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA), alleging that American Airlines violated USERRA by reducing benefits of pilots who had taken military leave without reducing the same benefits of pilots who had taken similar types of non-military leave. [CRT 06-015, Department of Justice (1/13/06)]

The allegations deal with accrual of vacation and sick time during the military leave. The government indicated that efforts to settle the claims had failed.
